Trash and debris throughout the neighborhood

The issue

Customer litter, including napkins, cups, and plates, is regularly left on the street, the public walkway, and neighbors' yards. The complex also stages its cans, bags, and boxes in the public right-of-way, blocking an entrance for hours at a time.

The code

§54.0208(a) makes it unlawful for a responsible person to fail to keep property under their control free from waste, and (b) extends that duty to the public walkway where the premises abut a street. §54.0210 prohibits littering outright, and §54.0201(f) declares waste in front of streets and sidewalks a public nuisance. Under §54.0205 these are strict-liability offenses, so intent does not matter.

Evidence

Napkins and food-service trash strewn across the walkway and into the street by the complex's back door. Neighbors have to step around trash left on our own sidewalk. Wrappers and a cup sit in the street where we live. Cups and debris pile up in the gutter outside the complex's service door. Customer trash blows clear onto a neighbor's yard. Litter trails down our street and gutter from the complex. Cardboard and a wood pallet block the back entrance walkway. Cups and wrappers gather along the neighbors' property line. July 10, 2026, 8:33 a.m.: cardboard and produce boxes strewn across the walkway toward the street. July 9, 2026, 6:29 a.m.: a recycling bin, a trash bag, and a produce box left out by the enclosure.
